1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") govern your access to and use of the website https://pearlearthjewelry.com ("Site") and the purchase of any products offered through the Site. The Site is operated by:

(hereinafter "Pearl Earth Jewelry," "we," "us," or "our").

By accessing the Site or placing an order, you ("Customer," "you," or "your") agree to be bound by these Terms, our Privacy Policy, Return & Refund Policy, Shipping Policy, and Product Disclaimer. If you do not agree, do not use the Site and do not place an order.

2. ELIGIBILITY

You must be at least 18 years of age and legally capable of entering into a binding contract to purchase products from Pearl Earth Jewelry. By placing an order, you represent that you meet these requirements.

3. PRODUCT INFORMATION AND ACCURACY

Pearl Earth Jewelry makes commercially reasonable efforts to display accurate product descriptions, images, materials, and pricing. However, we do not warrant that product descriptions, colors, finishes, or other content are accurate, complete, reliable, current, or error-free.

Our products are fashion accessories and decorative stones. Natural stones vary in color, shape, size, pattern, and marking. Each stone is unique, and the item you receive may differ in appearance from the images shown. These variations are natural characteristics, not defects.

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information at any time without prior notice (including after you have placed an order).

4. MATERIALS — IMPORTANT

⚠️ Unless a product page expressly and specifically states otherwise, our jewelry and accessories are fashion items and are NOT made of precious metals or precious stones. Specifically:

a) Metal components are base metal, alloy, or plated finishes described as "gold-tone," "silver-tone," or similar. They are not solid gold, solid silver, or other precious metals unless a product page expressly states a specific karat or fineness;

b) Stones described as "healing stones," "crystals," or by a stone name (such as "rose quartz" or "amethyst") are natural or reconstituted decorative stones sold as fashion and decorative items. We do not represent them as investment-grade, certified, or graded gemstones;

c) Any pearls offered are cultured, shell-based, glass-based, or imitation pearls unless a product page expressly states "natural pearl." Imitation pearls are identified as such on the relevant product page.

5. NO MEDICAL, HEALTH, OR THERAPEUTIC CLAIMS

⚠️ Pearl Earth Jewelry products are sold as decorative fashion accessories. Any descriptions referring to "healing," "energy," "balance," "protection," "chakras," or similar metaphysical properties reflect traditional folklore, cultural beliefs, and spiritual traditions. They are provided for interest and entertainment only.

These descriptions are NOT statements of fact, are NOT scientifically proven, and are NOT medical, therapeutic, or health claims. Our products are not intended to diagnose, treat, cure, or prevent any disease or condition, and are not a substitute for professional medical, psychological, or health advice. 6. ORDERS AND ACCEPTANCE

Placement of an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our sole discretion, including in cases of suspected fraud, inaccurate customer information, product unavailability, pricing errors, or suspected violation of these Terms.

An order is not accepted until we send a shipping confirmation email. We are not obligated to fulfill orders containing pricing errors, even if payment has been processed; in such cases, we will issue a full refund.

7. PRICING AND PAYMENT

All prices are listed in U.S. Dollars (USD). Prices are subject to change without notice.

⚠️ All applicable U.S. import duties and customs charges are prepaid by us through our shipping arrangement (Delivered Duty Paid). You will not be charged any additional customs, duties, tariffs, or carrier handling fees at delivery. The price shown at checkout is the full price you pay.

Applicable U.S. state sales tax (where required by law) will be calculated and displayed at checkout.

We accept payment via Shopify Payments (Visa, Mastercard, American Express, Discover), and any additional methods shown at checkout (which may include Shop Pay, Apple Pay, and Google Pay). Payment is processed at the time of order placement.

8. SHIPPING

Products are shipped directly from our supplier's warehouse in the People's Republic of China to customers in the United States. Estimated delivery time is 10 to 21 business days from dispatch. Full shipping terms, including our Delivered Duty Paid arrangement, are set forth in our Shipping Policy.

9. RETURNS AND REFUNDS

Returns and refunds are governed by our Return & Refund Policy. ⚠️ For hygiene reasons, pierced earrings cannot be returned once the sealed packaging has been opened, unless the item is defective.

10. CALIFORNIA PROPOSITION 65 NOTICE

⚠️ WARNING: Some products sold on this Site can expose you to chemicals including lead and cadmium, which are known to the State of California to cause cancer and birth defects or other reproductive harm. Jewelry and decorative stones may contain these substances. This warning is provided in compliance with California Proposition 65 (Cal. Health & Safety Code § 25249.6 et seq.).

⚠️ As a general safety precaution, our jewelry and decorative stones are intended for personal decorative use only. They are not intended to be swallowed, chewed, or placed in the mouth, and are not suitable for children under the age of 12. Keep small items away from young children and pets, as they may present a choking hazard.

11. INTELLECTUAL PROPERTY

All content on the Site — including text, graphics, logos, images, videos, product designs, and the Pearl Earth Jewelry brand — is the property of Starc Ecom B.V. or its licensors and is protected under U.S., Dutch, European, and international intellectual property laws.

You may not copy, reproduce, distribute, modify, transmit, display, publish, sell, license, or create derivative works from any content on the Site without our prior written consent.

12. PROHIBITED USES

You may not use the Site to: violate any applicable law; infringe any third party's rights; submit false or fraudulent information; interfere with or disrupt the Site (including viruses, scraping, or automated access); resell or commercially exploit products without our written consent; or impersonate any person or entity.

We reserve the right to terminate access, cancel orders, and pursue legal remedies for violations.

13. DISCLAIMERS AND LIMITATION OF WARRANTIES

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, EXCEPT FOR RIGHTS THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

To the fullest extent permitted by applicable law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimer is prohibited by law.

We do not warrant that any product will produce any particular effect, appearance, or result. We make no representation that any stone or accessory has any metaphysical, healing, or therapeutic effect.

Nothing in these Terms excludes or limits the statutory conformity rights of consumers under applicable law.

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

a) IN NO EVENT SHALL PEARL EARTH JEWELRY, STARC ECOM B.V., OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING (WITHOUT LIMITATION) LOST PROFITS, LOSS OF DATA, EMOTIONAL DISTRESS, OR LOSS OF GOODWILL;

b) OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF AN ORDINARY COMMERCIAL DISPUTE (SUCH AS A PRICING, SHIPPING, OR REFUND DISPUTE) SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM;

c) NOTHING IN THESE TERMS LIMITS OR EXCLUDES OUR LIABILITY FOR: (i) death or personal injury caused by our negligence or a defective product; (ii) liability under applicable product liability law; (iii) fraud or fraudulent misrepresentation; or (iv) any other liability that cannot be excluded under applicable law.

Some states do not allow certain limitations, so portions of this Section may not apply to you.

15. INDEMNIFICATION

You agree to indemnify and hold harmless Pearl Earth Jewelry, Starc Ecom B.V., and their respective officers, employees, agents, and suppliers from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of a product, or your violation of any law or third-party right. This indemnification does not apply to claims arising from a defective product or our own negligence.

16. GOVERNING LAW AND JURISDICTION

These Terms and any dispute arising out of or relating to them, the Site, or any product are governed by the laws of the Netherlands, without regard to conflict of laws principles.

Any dispute shall be brought exclusively before the competent courts of Amsterdam, the Netherlands.

This Section does not affect any mandatory consumer protection rights that may apply in your state of residence and that cannot be waived by contract.

17. THIRD-PARTY LINKS

The Site may contain links to third-party websites. We are not responsible for the content, privacy practices, or availability of any third-party site. Use is at your own risk.

18. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Changes are effective when posted with an updated "Last updated" date. Your continued use of the Site constitutes acceptance of the modified Terms.

19. SEVERABILITY

If any provision is held invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision is modified to the minimum extent necessary to make it enforceable.

20. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Return & Refund Policy, Shipping Policy, and Product Disclaimer, constitute the entire agreement between you and Pearl Earth Jewelry regarding your use of the Site.
